The Queensland criminal law process can be complicated and intimidating and is comprised of charges at multiple degrees of severity. Summary offences are those offences that are considered to be less serious and are dealt with in the Magistrates Court. In Queensland these charges can include traffic offences, disorderly behavior offences and minor criminal matters. Indictable offences are those offences where the accused has the right to be tried before a Judge and jury. These are heard in the superior courts (District or Supreme Courts) and can include more serious criminal offences such as murder, theft, armed robbery and sexual-related offences.

At your first court appearance, you will be asked to enter a plea of guilty or not guilty. If you are unsure of what to do or require more time to source legal advice, you are within your rights to request for an adjournment. You should make sure you completely understand what it is you have been charged with and you should read and understand the prosecutions statement of events. The way the matter progresses from here depends largely on what you have been charged with, how you plea and the availability of evidence against you.

I Have Been Arrested. What Should I Do?

Contact your solicitor immediately. Depending on what you have been charged with, you may need to apply for bail. Your solicitor can discuss the options with you and assist you to decide what to do next. If you are a current member of the ADF, you must inform your chain of command.

The Police Want Me to Participate in an Interview, What Should I Do?

Ask the police whether you are a 'suspect in a crime' or a 'witness'. You should answer questions relating to your identity, such as your name and address. However, you should seek legal advice before answering any other questions, particularly if you have been cautioned by the police. Request to call your solicitor as soon as possible and discuss your options.
